There are three ways to get a divorce; by default, settlement,
or trial.
Default:
If no response was filed a request for default can be submitted 31 days after
the Respondent has been served. Even in cases of default it still takes 6
months plus one day for the divorce to be final. (Six months and 1 day from
the date the summons was served.)
Settlement: This is
the most common method used to obtain a judgment. This is the written
agreement that states specifically how the community property (assets and
debts) is divided and if there are children of the marriage (or born prior to) it also details custody,
support, and visitation.
Trial:
For very good reasons this is the least common way that people obtain their
divorce judgment. In those cases where the party’s cannot come to
agreement or settle their own issues -without the court’s help- then
a judge will make these decisions for them.
